Nobody really knows. This has not been well tested. "It's a totally open question in the law," says some professor of criminal law at Georgetown University. There are arguments on both sides. One view: If you're doing DHCP and you're broadcasting your SSID, it's a form of an invitation. The other: If you leave your garden hose in your front yard, that doesn't give your neighbor permission to wash his car.
